At least the Judge had sense to say no to this one, seem to be far to many bizzare cases that get won nowadays since the American Mcdonalds coffee case.

Maybe I should drop my lawsuit against my oven manufacture after burning myself after heating it to gas mark 9.
I swear all suits like this need to be chucked out.. Health and Safety is the bane of my life at the best of times, never mind people too stupid to think hot coffee would be hot.

I agree to a certain extent, obviously consumers do need to be protected in some cases but examples like this could easily be thrown out of court even before it gets that far. Common sense should prevail!!

If we are going to allow compensation at all then where do we draw the line? We cannot possibly legislate for every possible outcome. And decide what can be sued for and what can’t.
I do think however that the solicitors who bring these cases forward could act more responsibly when choosing cases. But if you dangle free money in front of people they will take every opportunity to get their hands on it!

IMHO the line is drawn based on how sensible the claim is. It’s quite easy for someone to judge the claims before they arrive on court and apply ‘thisistooamerican’ policy to it and if it applies then don’t allow it
We don’t need to legislate every individual scenario, just have guidelines in place like we do for most types of criminal court cases.
Problem with solicitors acting responsible is the same point as dangling free money in peoples faces, your going to get solicitors who are literally in it for cash
